Brandon
Shelton had admitted to him, while sober, inside a Food Lion store
that he had killed Viktor Gunnarsson by saying “OK. I’ll tell you I
killed Viktor Gunnarsson”. After Shelton confessed to the murder,
Shelton threatened to kill him (Smith) if he ever told anyone.

Shelton admitted that one night in
November 1993, he came home from work to find Gunnarsson and another
man at his home with his wife Heather Shelton. Shelton admitted that
he was angry and threatened to kill Gunnarsson and his wife.

Shelton admitted to him that he was
extremely jealous of his wife and he hated Gunnarsson over the affair.

Shelton had shown him a white briefcase
and told him the briefcase contained a gun and confession to the
murder.

Shelton admitted that on December 3,
1993, he (Shelton) and Michael Blackwelder had borrowed a .22 caliber
pistol from his (Shelton’s) neighbor. They went to Gunnarsson’s
apartment that afternoon and were going to “do
Viktor” then, but
Viktor had a friend there and he and Blackwelder did not want to hurt
him. Shelton admitted to him that he and Blackwelder decided to
return later that night and get Gunnarsson.

Brandon Shelton admitted to him that on
the night of the murder, he (Shelton) and Michael Blackwelder went to
Gunnarsson’s apartment and Blackwelder
let them
inside with a key.
Shelton admitted that Gunnarsson was coaxed out of bed on the pretense
of going to a party and when Gunnarsson got out of bed, they jumped
him. They used tape found at Gunnarsson’s apartment to bind and gag
him. Gunnarsson was carried down and put in the trunk of Gunnarsson’s
car and driven to the mountains where Gunnarsson was shot in the
head. Shelton admitted that after the murder, Gunnarsson’s car was
cleaned out and Gunnarsson’s clothes were thrown in a dumpster.

Smith had asked Michael Blackwelder
once about the murder and Blackwelder had stated “Yeah, we killed
him”.

Blackwelder had told Smith that he had
sex with Gunnarsson for money

never called to testify on my behalf
